Acceptance of Terms
By accessing or using Favstir, you agree to these Terms of Service. If you do not agree, do not use the service.
Favstir is a Dezolve Labs company.
Eligibility and Accounts
- You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use Favstir.
- You must provide accurate account information and keep it up to date.
- You are responsible for safeguarding your account and for all activity under your account.
- You must notify us promptly if you believe your account has been compromised.
Description of the Service
Favstir is a web-based application that allows users to create, organize, and share lists of places, notes, links, and recommendations.
We may modify, suspend, or discontinue any part of the service at any time.
User Content and License
You retain ownership of the content you submit to Favstir, including lists, items, and notes.
By using the service, you grant Favstir a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, and display your content solely as needed to operate, secure, maintain, and improve the service.
You represent that you have the rights needed to submit and share your content.
Acceptable Use
You agree not to:
- Violate any law or third-party rights
- Upload or share unlawful, infringing, abusive, harassing, hateful, or fraudulent content
- Attempt to gain unauthorized access to systems or accounts
- Interfere with service reliability, security, or performance
- Use bots or automated methods to abuse, scrape, or overload the service beyond reasonable use
Sharing and Public Access
- Lists are private by default.
- If you share a list or make it public, it may be viewed by others according to your chosen visibility settings.
- Anyone with an unlisted share link may be able to access that content.
- You are responsible for the content you choose to share publicly or by link.
Third-Party Services and Analytics
Favstir relies on third-party services, including authentication providers and analytics tools.
If you grant analytics consent, Favstir may use tools such as Google Tag Manager, Google Analytics, and Microsoft Clarity to measure usage, troubleshoot issues, and improve the service. These services may process technical data under their own terms and privacy policies.
Intellectual Property
The Favstir service, including software, design, branding, and related materials, is owned by Dezolve Labs or its licensors and is protected by applicable intellectual property laws.
Except as expressly permitted, you may not copy, modify, distribute, reverse engineer, or create derivative works from the service.
Service Availability and Disclaimers
Favstir is provided "as is" and "as available."
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the service will be uninterrupted, error-free, secure, or suitable for every use case.
Limitation of Liability
To the fullest extent permitted by law, Favstir and Dezolve Labs will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, revenue, goodwill, or business opportunities, arising out of or related to your use of the service.
To the fullest extent permitted by law, our total liability for claims relating to the service will not exceed the greater of (a) USD $100 or (b) the amount you paid us for the service in the 12 months before the claim.
Indemnification
You agree to defend, indemnify, and hold harmless Favstir and Dezolve Labs from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your content
- Your misuse of the service
- Your violation of these Terms or applicable law
- Your infringement of any third-party rights
Suspension and Termination
We may suspend or terminate access to the service at any time, including for violations of these Terms, suspected abuse, security risks, or legal compliance reasons.
You may stop using the service at any time.
Governing Law and Venue
These Terms are governed by applicable law in the jurisdiction where Dezolve Labs is established, without regard to conflict-of-law rules.
Unless prohibited by applicable law, disputes arising out of these Terms will be resolved in courts located in that jurisdiction, and you consent to those courts' jurisdiction.
Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date.
Your continued use of the service after updates become effective constitutes acceptance of the revised Terms.
